AMIGO TRAILS UPDATED BOOKING AND CANCELLATION POLICY
Updated 24 April 2020. See Below for original terms and conditions that still apply outside of the new AMIGOFlex booking and cancellation policy.

Here listed are the terms and conditions “T & Cs” for Amigo Trails, hereafter referred to as “Amigo Trails” “We”, “Our”, or “Us”. These T & Cs relate to the travel packages supplied through Amigo  Trails in the Copper Canyon of Mexico.
“Booking Form” means the electronic booking form incorporating these T&Cs that the Lead Client/Participant and each person listed in the group electronically agree to.
“Lead Client” means the person as set out as such in the Booking Form.

AGREEMENT

1.1 The T & Cs contained in this document together with your Booking Form comprise the contract between Amigo Trails and all persons listed on the Booking Form. The contract is deemed to have been made as soon as the Booking Form has been sent and completed online by the Lead Client, accompanied by a NON REFUNDABLE Deposit or full payment as applicable.

1.2 When payment has been made over the telephone, without a Booking Form being completed, a contract will come into existence immediately between you and Amigo Trails upon processing of a credit/debit card payment for Deposit or full payment of your holiday. This will be oral confirmation of your booking. Written Confirmation will be subsequently sent via email.

1.3 The Lead Client is responsible, on behalf of all other members of the group, for all matters relating to the booking, thus he/she will be personally liable for all monies outstanding from the remainder of the guests listed on the booking form.

1.4 “The Group” refers to all persons on the trip and listed on the Booking Form and also includes any subsequent changes of names to the original booking.

1.5 If at any time, prior to the start of the holiday, there is a change of Lead Client, Amigo Trails must be notified, either by email or telephone, by the original Lead Client.

Amendment 22 April 2020 in line with **AMIGOFLEX** Flexible Booking Policy

2.0 BOOKING

2.0 (a) Any Bookings received for holidays with arrival dates from 1st July 2020 will be subject to the new rules of AMIGOFlex. This includes all bookings made before 22nd April 2020 for holiday start dates falling within the period from 1st July 2020 and beyond, until further notice. Amigo Trails reserves the right to amend these dates at any time.
2.0 (b) AMIGOFlex deposit payments are transferable to another catered holiday with a start date any time within 24 calendar months from your original holiday start date, subject to availability.
2.0 (c) AMIGOFlex entitles you to only 1 free-of-charge date change to your original holiday. You can choose to change to a new summer or winter holiday date, regardless of which season your original booking was made for, subject to availability.
2.0 (d) AMIGOflex will allow you to make a date change up to 60 days before your original holiday start date.
2.0 (e) AMIGOFlex does not apply once you have entered the 60 day final balance payment period. At this point you are obliged to pay for your holiday in full and our regular T&C’s will apply. This means that there will be no refund or transfer of holiday dates offered.
2.0 (g) AMIGOFlex cannot be used in conjunction with any other voucher or gift card  issued by Amigo Trails at any time.
2.0 (f) AMIGOFlex Deposits are non refundable.

2.1 The final balance outstanding on your holiday must be paid 60 days before the start date of your holiday with Amigo Trails. For bookings made within the 60 day start date period, the full cost of the holiday will be payable at the time of booking to secure your reservation.

2.2 If the final balance is not received 60 days before the start date of your holiday with Amigo Trails, we reserve the right to cancel the booking and retain any Deposit paid and levy cancellation charges. Amigo Trails then reserves the right to re-book the same dates to another client without notification.

2.3 If you or your party change any of your flight details, or arrival / departure dates, after having booked your holiday, and Amigo Trails have made any other arrangements on your behalf, an administrative charge of $50USD (pesos equivalent) may be incurred, which will be added to your final balance.

Original Terms and Conditions (still apply outside of the new Booking and Cancellation MoreFlex policy stated above.)

Read this agreement thoroughly as your approval of a quote to book a trip package with Amigo Trails implies full consent to all terms and conditions listed below.

Agreement: The terms and conditions set forth in this agreement constitute the entire understanding and agreement between you the trip “Participant” and Amigo Trails, “AT”, with respect to any and all bookings, tours or transactions made with Amigo Trails.

Submitting a booking form constitutes acceptance of this agreement, and you accept all of the terms in this agreement as lead booking client/participant and direct us to perform services on your behalf and in your name. All persons named in this booking (“Participants”) are subject to this agreement. As lead client/participant, you affirm that you have made all other Participants listed in the booking aware of these terms - regardless of how final payment is made - and that all Participants accept these terms.

Reservations: All tours are 100% private and can be reserved only via email, though you may send us a contact inquiry from our website form as a means of establishing communication about a specific tour. A booking is not final until you receive a final confirmation from us that states your booking is in progress.

Deposits and Final Payment: A non-refundable deposit of $500USD per person (peso equivalent will be charged and will depend on exchange rate at time of payment) per tour is required at the time of booking. Final payment is due 60 days prior to trip start date. If your booking is made within 60 days or less of trip start date, the entire trip cost must be paid when we confirm the trip with you and it is non-refundable for any reason. We highly recommend you purchase your own trip insurance to cover you for any unforeseen eventualities such as medical emergencies, trip delay, trip cancellation, lost luggage, etc….

Payments may be made by credit card or bank wire transfer. If you pay your deposit by wire transfer, we cannot confirm your reservation until your payment has cleared the bank. All wire transfer fees incurred by your own bank are your own responsibility and must be paid by you to your bank directly and separately from the tour total. The tour total requested must be the exact amount that arrives in our bank in order to confirm your booking so be sure to pay any bank fees your bank may charge you on your end separately from the transfer.

Cancellations by You and Refunds: To cancel your booking, you must submit your request to us in writing, by email, to info@amigotrails.com. Cancellation fees will be applied per person according to the following schedule, based on the date we receive your written notification:

Up to 61 days prior to departure, 100% minus the non-refundable deposit and minus any monies that may be required to return the refund to you.

After 60 days, there are no refunds for any reason. We highly recommend you purchase trip insurance to cover yourself for any cancellations.

No refunds will be provided for any unused portion of a tour once the tour begins, including if you leave a tour for any reason or have to be removed from a tour. There are no exceptions to this cancellation and refund policy. Amigo Trails cannot accept responsibility, pay compensation or issue refunds where the performance of our contractual obligation is prevented by or affected by events amounting to Force Majeure (Force Majeure meaning acts of war or threat of war, political unrest, terrorist activities, adverse weather conditions, volcanic ash clouds, strikes, acts of God, epidemics, pandemics, riots, civil strife, industrial disputes, terrorist activity, natural or technical disasters, nuclear war) and or similar events out of our control. (“Force Majeure”)

Changes by You: If you change your tour dates or alter your itinerary after we confirm your tour, a change fee will be imposed that must be paid immediately. The type and scope of change dictates the amount of the change fee. Our outside suppliers, including hotels and transfer services often impose additional fees or penalties for changes and cancellations. These are included in the change fee and can be substantial, depending on the supplier and its own internal policies that we must follow.

Cancellations or Changes by Us and Flexibility: We reserve the right to cancel, alter or modify any tour without prior notice for the safety and/or comfort of clients. You acknowledge that the amenities, accommodations, transportation, route, schedule, and itinerary may change without prior notice due to local circumstances or events, which may include mechanical breakdown, road closures, flight cancellations, illness, strikes, political disputes, weather, border crossing problems, Chepe train changes, and other unforeseeable factors. If, prior to departure, we make a significant change because of a problem with a supplier (e.g., bankruptcy), we will, as soon as reasonably possible, notify you of available alternatives.

Any changes may require a supplemental payment from you or result in a refund less any cancellation fees and non-refundable deposits. No refunds under this paragraph will be provided due to cancellations or changes due to Force Majeure.

Price Adjustments: The quoted tour price is based on tariffs, fees, and costs in effect at the time you send in your booking form, which stipulates acceptance of this agreement. We reserve the right to increase the quoted price after booking if inflation, costs of fuel, labor or materials, airfares, supplier costs, currency exchange rates, tariffs, government fees, and admission charges change dramatically. You agree to, and will pay for any price increase should such an occasion arise.

Credit Card Authorization for Post-Booking Charges: You authorize Amigo Trails to bill you for any change fees, price increases, or supplemental payments that you incur post-booking, and you promise to pay for those fees should they be required. Should you damage any equipment, hotel rooms, vehicles or other properties during your trip, due to negligence or hostile intent, you will also be billed for these items post-booking and you promise to pay for those fees should they be required.

No Refunds for Personal ExpensesYou will not be reimbursed for any personal expenses such as airfare, hotel or other travel expenses due to changes in itineraries or tour cancellations. Any changes, or change fees you may incur due to Force Majeure is included as non refundable, and you agree to pay for any fees required if you decide to continue with your trip.

Responsibility: Amigo Trails acts only as an intermediary for the various independent suppliers that provide lodging, meals, transportation, sightseeing, activities or other goods and services connected with your tour (“Supplier” or “Suppliers”). You acknowledge that you are aware and clearly understand that these Suppliers are independent contractors, and are not managed by Amigo Trails, and are not agents, nor employees of Amigo Trails. A Supplier’s services are subject to the Supplier’s own terms and conditions and the local laws and regulations of the relevant country.  Amigo Trails will not provide any refund for a Supplier’s delay, cancellation, overbooking, or strike, but we will do our best to help solve any problems upon your behalf as intermediaries.

Force Majeure: Amigo Trails will not be deemed in breach of this agreement or otherwise liable to you, by reason of delay in performance or nonperformance of any of its obligations under this agreement to the extent that any such delay or nonperformance is due to any Force Majeure. “Force Majeure” means any circumstances beyond the reasonable control of Amigo Trails, including without limitation acts of God, terrorist activities, insurrection, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, sabotage, civil disturbance, labor strikes, requisition, sickness, quarantine, epidemic, pandemic, government intervention, weather conditions, and unforeseen circumstances.

If Amigo Trails and/or any of its Suppliers are affected by Force Majeure, they shall be entitled to, and may in their sole discretion, vary or cancel any itinerary or arrangement in relation to the tour. Regarding civil unrest, once Amigo Trails has investigated the prevailing situation, as it deems fit, it shall remain in Amigo Trails’ sole and absolute discretion whether to proceed with the tour.

Travel Insurance: The tour price does not include travel insurance. We strongly recommend that you purchase comprehensive travel insurance, covering trip interruption and cancellation, baggage, medical, accident/life, evacuation, repatriation and other expenses which might arise as a result of loss, damage, injury, delay or inconvenience occurring to you. You agree to assume all costs of medical care and transportation. As such, we require that you purchase travel-related medical insurance if your current medical policy does not cover you during your tour. We may require proof of coverage.

Pre-Departure DocumentationIt is important that you carefully read all trip-related documents that you receive from us as soon as you receive them. It is your responsibility to contact us if any information is incorrect. We cannot accept any liability if you do not notify us of any inaccuracies within 3 days of your receipt of those documents. This agreement, a waiver of liability and assumption of risk agreement and, if required, a medical statement or certification must be signed and submitted by you if we request it. If you fail to submit this and other necessary documentation prior to departure, we reserve the right to treat your booking as cancelled by you and impose the cancellation fees described in this agreement.

Passports and Visas: You are responsible for ensuring that all necessary travel documents are valid and effective and in your possession for the entire tour. Passports are required for all U.S. citizens traveling abroad and should be valid for at least 6 months after your date of return. We suggest you apply for or renew a passport early. Other required documents may include visas, permits, and vaccination certificates. You assume complete and full responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements. You are also solely responsible for any adverse consequences resulting from incomplete or defective documentation. While we may provide information or advice on matters such as visas, vaccinations, climate, clothing, baggage, and special equipment in good faith as a courtesy to you, we are not responsible for any errors or omissions as to the information provided.

Health Requirements and Medical Care: Our tours are physically active, with varying levels of demands and fitness requirements depending on the specific itinerary. Submitting a booking form constitutes acceptance of this agreement, thereby consigning this agreement, you represent that you do not have any physical or other conditions that would create a hazard for you or other Participants or affect other people’s enjoyment of the tour. If you have a physical condition, dietary restrictions, or other conditions that will require special attention during the tour, you must inform us in writing when the booking is made. We may require a medical certificate if you have a special condition. We reserve the right in our sole discretion to accept, decline, or remove anyone from a tour (at departure or during the tour) who we judge to be incapable of meeting the tour’s physical demands.

Amigo Trails assumes no responsibility for any medical care provided to you. You agree to assume all costs of medical care and related transportation that are provided to you during the tour.

Complaint ProcedureIf you have a complaint during your tour, you must promptly notify Amigo Trails via email and your tour leader of the problem so that they can attempt to remedy the situation. Failure to do so while you are on the tour will extinguish your ability to claim compensation from Amigo Trails. Further, if you attempt to address the problem on your own without using this notice procedure, you assume responsibility for any added costs you may incur and forfeit any potential refunds.

If you are not satisfied after using this notice procedure, you must submit your complaint in writing to Amigo Trails within 2 days of the tour’s end date. Amigo Trails will not accept any liability for claims received after this period.

Tour Start Date: It is your responsibility to be ready to embark on the tour as specified in the itinerary. Amigo Trails is not responsible for any losses due to cancelled or missed flights, changed flight itineraries, late arrivals, or early departures.

Compliance with Local Laws and Tour Etiquette: You must strictly comply with all local laws, respect local customs and culture, accurately assess your abilities, respect other trip members’ privacy, and follow the suggestions and advice of any assigned guide. The decision of the local guide or local supplier is final on all matters that may threaten the safety or interfere with the well-being of others. During the tour, Amigo Trails or the local guide/supplier has the right in its sole discretion to remove anyone a) whom it judges to be incapable of meeting the demands and requirements of participating in the tour activities; or b) whom it determines to detract from others’ enjoyment of the tour.

Images Release: You agree that Amigo Trails may use, re-use and reproduce any images, photos or videos that you send to us, or that are taken by our guides and/or other travelers of you individually or in a group, in any medium, including but not limited to print, electronic media, or Internet, free of charge and without your right to inspection, for promoting and publicizing our travel products and services worldwide. If you do not want us to use any images of you that are taken by us or other participants during the tour, you must inform Amigo Trails and your tour leader in writing at the start of the tour.

Limitation of Remedies: You agree that the sole remedy for any default by Amigo Trails arising under this agreement shall be the return of the paid tour cost. To the maximum extent permitted under applicable law, Amigo Trails shall not be liable for any special, consequential, indirect, incidental or other damages arising out of or in any way connected to this agreement, including lost profits, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if Amigo Trails has been advised of the possibility of such damages. You expressly waive any right you may have to recover such damages.

Severability: If any provision of this agreement shall be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render the agreement unenforceable or invalid as a whole. Such unenforceable provision will be replaced with one that is valid and enforceable and which achieves, to the extent possible, the original objectives and intent of the original provision.

Successors and Assigns: This agreement shall inure to the benefit of and be binding upon Amigo Trails and the Participant and their respective heirs, legal personal representatives, successors and assigns.

Updating of Terms and ConditionsAmigo Trails reserves the right to update and/or alter these terms and conditions at any time. It is your responsibility to be familiar with these terms and conditions. The latest terms and conditions can be found on the Amigo Trails website www.AmigoTrails.com.

Applicable Law and Choice of Forum: Any dispute arising out of this agreement, including all tort claims - whether such dispute arises in contract or in tort or otherwise - shall be litigated and determined, if at all, only before a court of competent jurisdiction in Chihuahua City, Chihuahua, Mexico (and in no other).

Merger: This Agreement is the final, complete and exclusive statement of the parties’ agreement on the matters contained in this agreement. It supersedes all previous negotiations and agreements.
